• You may not use the reports in a manner that could harm HookTide's reputation

The LinkedIn profile data analyzed by our Service is publicly available information from LinkedIn. We do not claim ownership of this third-party content. LinkedIn and all related trademarks, service marks, and logos are the property of LinkedIn Corporation.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOOKTIDE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of or inability to access or use the Service
• Damages resulting from any conduct or content of any third party on the Service
• Damages resulting from any content obtained from the Service
• Damages resulting from unauthorized access, use, or alteration of your transmissions or content

9. Service Availability and Modifications

9.1 Availability

We do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

9.3 Report Retention

Analysis reports are automatically deleted from our systems 30 days after creation. If you wish to retain a report beyond this period, you must download and save it before it expires.

The Service may contain links to third-party websites or services that are not owned or controlled by HookTide. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that HookTide shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11.3 Waiver of Class Action

You agree that any disputes shall be resolved on an individual basis and that you waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms constitute the entire agreement between you and HookTide regarding the use of the Service and supersede all prior agreements and understandings.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

13.3 Waiver

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.
